Unless the public comes to agree that the benefits of food biotechnology are desirable and the associated risks are acceptable, our society may fail to realize much of the potential benefits. Three historical cases of major technological innovations whose benefits and risks were the subject of heated public controversy are examined, in search of lessons that may suggest a path toward consensus in the biotechnology debate. In each of the cases—water fluoridation, nuclear power and pesticides—proponents of the technology gathered scientific (...) evidence that they believed established that the innovations were safe. In each case, the federal government was heavily involved in oversight, safety regulation, and in the first two cases, active promotion of the technology. Supporters of the technologies employed a variety of communications strategies, ranging from massive “educational” campaigns (e.g. “Our Friend The Atom”) to vituperative ad hominem attacks on leading opponents. None of these strategies succeeded in achieving broad societal acceptance of the technologies. Fluoridation today is opposed as vigorously by activist groups as it was when first introduced around 1950; it has not been universally adopted even in the U.S., and it has been rejected in most other countries. The American nuclear power industry is moribund, and the public has essentially rejected the technology. The pesticide industry is thriving, with new generations of products succeeding older more hazardous chemicals in a constant cycle. However, strong regulation has failed to prevent adverse health and ecological effects, which have been empirically associated with pesticide uses after the chemicals were dispersed in the environment. Debate over whether risks of such effects are acceptable has been heated for four decades, with scientists and the public divided. None of these cases offers an ideal model for the biotechnology revolution, though they do reveal many strategies that have not worked. The biotechnology debate is also taking place at a time when our concepts of risk communication have improved, and when many consumers are more actively concerned with buying products perceived to be less likely to harm the environment. Based on the three case histories and more recent trends, some characteristics of a process for seeking a societal consensus are described. They include explicitly defining the subjects for consensus; including all stakeholders in a respectful dialogue; confronting value issues, such as acceptability of risks and ethical perceptions; listening to others’ perspectives, and being willing to change one’s own point of view. If activists on all sides of the food biotechnology debate are willing to commit to such a consensus-building process, there is hope that the U.S. national debate can be resolved in a manner satisfactory to essentially all parties. This report describes a consultation case between a special education teacher and a school psychology student for a first grade student with a diagnosis of educable mental impairment. Adherence to data-based decision making and direct manipulation of hypothesized variables believed to be maintaining problem behaviors in the classroom revealed factors that were influencing the child’s behavior in the classroom. The teacher changed her behavior toward the student before a formal intervention plan could be developed and changes in student behavior were (...) observed. Child outcomes were systematically measured. Also, the acceptability of the consultation process was assessed. Results are discussed in terms of the possible reactive effects to behavioral consultation and functional assessment that may occurfor teachers who see solutions enlerge during data-based consultative problem solving. A new translation of Aristotle's classic work on the natural sciences.

While ethical norms for conducting academic research in the United Kingdom are relatively clear, there is little empirical understanding of how university research ethics committees (RECs) themselves operate and whether they are seen to operate well. In this article, we offer insights from a project focused on the Scottish university context. We deployed a three-sided qualitative approach: (i) document analysis; (ii) interviews with REC members, administrators, and managers; and (iii) direct observation of REC meetings. We found that RECs have diverse (...) operation and vary in terms of what members understand to be the remit of their REC and what should constitute the content of ethics review. Overall, though, most participants perceive university RECs as operating well. When asked what they consider to be areas for further improvement, most commented on: implementation of an online system; more experience with how to evaluate various kinds of research projects; best practice exchange and training opportunities; more accurate reflection of the REC role as part of the university’s workload allocation model; and greater recognition of the importance of research ethics governance in the university’s research environment, and, for the members themselves, their career advancement. Based on our findings and subsequent discussions during an end-of-project roundtable with stakeholders, we propose a model of collaboration that can address some of the identified areas that could benefit from further improvement. This model would facilitate a heightened awareness of the importance of supporting REC members in their own effort in assisting students and staff alike in undertaking as ethically robust research as possible. This article describes, analyzes, and advocates for management of clinical healthcare conflict by a process commonly referred to as bioethics mediation. Section I provides a brief introduction to classical mediation outside the realm of clinical healthcare. Section II highlights certain distinguishing characteristics of bioethics mediation. Section III chronicles the history of bioethics mediation and references a number of seminal writings on the subject. Finally, Section IV analyzes barriers that have, thus far, limited the widespread implementation of bioethics mediation.

Since neither of these two inordinately long responses deals seriously with what I said in “An Ideology of Difference” , both the Boyarins and Griffin are made even more absurd by actual events occurring as they wrote. The Israeli army has by now been in direct and brutal military occupation of the West Bank and Gaza for twenty-one years; the intifadah, surely the most impressive and disciplined anticolonial insurrection in this century, is now in its eleventh month. The daily killings (...) of unarmed Palestinians by armed Israelis, soldiers and settlers, numbers several hundred; yesterday two more Palestinians were killed, the day before four were killed. The beatings, expulsions, wholesale collective punishments, the closure of schools and universities, as well as the imprisonment of dozens of thousands in places like Ansar III, a concentration camp, continue. A V sign flashed by a young Palestinian carries with six months in jail; a Palestinian flag can get you up to ten years; you risk burial alive by zealous Israel Defense Forces soldiers; if you are a member of a popular committee you are liable to arrest, and all professional, syndical, or community associations are now illegal. Any Palestinian can be put in jail without charge or trial for up to six months, renewable, for any offense, which needn’t be revealed to him or her. For non-Jews, approximately 1.5 million people on the West Bank and Gaza, there are thus no rights whatever. On the other hand, Jews are protected by Israeli law on the Occupied Territories. In such a state of apartheid—so named by most honest Israelis—the intifadah continues, as does the ideology of difference vainly attempting to repress and willfully misinterpret its significance. In the field of natural science, Aristotle recognizes as his forerunners a select group of theorists such as Heraclitus of Ephesus, Empedocles of Acragas, Anaxagoras of Clazomenae, and Leucippus and Democritus of Abdera. In addition, he mentions in the same contexts some whose claims to be “natural philosophers” are doubtful, yet who deserve notice in the same context, including Parmenides of Elea, Melissus of Samos, the people called Pythagoreans, and Plato as the author of the Timaeus. Aristotle takes seriously almost (...) all of these people, treating them as exemplary pioneers and valuable partners in the enterprise of “natural philosophy.” This article examines earlier opinions on certain fundamental questions about the natural world, as treated in the first three books of the Physics and in the first book of the Metaphysics. In Physics II and III, Aristotle represents most if not all of his predecessors as disastrously misunderstanding, in more than one way, the nature underlying the natural world. (shrink)

The text is followed by a commentary on the relation of _Utopia_ to its own age and as it has been interpreted by scholars. Four different kinds of grammars that can define crossing dependencies in human language are compared here: (i) context sensitive rewrite grammars with rules that depend on context, (ii) matching grammars with constraints that filter the generative structure of the language, (iii) copying grammars which can copy structures of unbounded size, and (iv) generating grammars in which crossing dependencies are generated from a finite lexical basis. Context sensitive rewrite grammars are syntactically, semantically and computationally unattractive. Generating grammars have a collection of (...) nice properties that ensure they define only “mildly context sensitive” languages, and Joshi has proposed that human languages have those properties too. But for certain distinctive kinds of crossing dependencies in human languages, copying or matching analyses predominate. Some results relevant to the viability of mildly context sensitive analyses and some open questions are reviewed. (shrink)

David Hume (1711–1776) was born in Scotland and attended Edinburgh University. In 1734, after a brief spell in a merchant's office in Bristol, he went to France to write A Treatise of Human Nature, published anonymously in 1739 (Books I and II) and 1740 (Book III). An Abstract, also anonymous and written as if by someone other than the author of the Treatise, appeared about the same time, and provides an invaluable account, in a brief compass, of what Hume thought (...) most important about the Treatise. The Treatise was not well received, and Hume was unsuccessful in his candidature for the chair of moral philosophy at Edinburgh. He rewrote Book I of the Treatise, adding a controversial discussion of miracles and providence; and a revision of this was published as An Enquiry Concerning Human Understanding in 1748. His Enquiry Concerning the Principles of Morals, which was a rewriting of Book III of the Treatise, was published in 1751, and his Dissertation on the Passions, corresponding to Book II of the Treatise, but with significant omissions, such as the account of the psychological mechanism of sympathy, in 1757. In 1752 he had been made keeper of the Advocates' Library at Edinburgh, and wrote his History of England which, at the time, brought him more approbation than his philosophy. During this time, he wrote the Dialogues Concerning Natural Religion, published posthumously in 1779. In 1763 he became secretary to the British Embassy in Paris. He returned to London in 1766, and a year later was Undersecretary of State. In 1769 he returned to Edinburgh and worked on final editions of his writings, and on an autobiography, dated 18 April 1776, a few months before his death. (shrink)

In this article, responding to assertions that the principle of double effect has no place in legal analysis, I explore the overlap between double effect and negligence analysis. In both, questions of culpability arise in situations where a person acts with no intent to cause harm but where reasonable foreseeability of unintended harm exists. Under both analyses, the determination of whether such conduct is permissible involves a reasonability test that balances that foreseeable harm against the good intended by the actor's (...) conduct. In both, absent a finding that the foreseeable harm is unreasonable in light of that intended good, no liability will be imposed upon the actor. Even conceding, however, such general similarity between double effect and negligence analysis - disagreement over the proper interpretation of the reasonability criterion at play in negligence poses an additional challenge for the attempt to correlate negligence with double effect. Economic efficiency interpretations of negligence, for example, purportedly based on the Learned Hand Formula and the RESTATEMENT (SECOND) OF THE LAW OF TORTS, propose that culpability depends upon a utilitarian balancing of good effects of conduct (utility) versus its harmful foreseeable consequences (magnitude of risk of injury). Based on such an interpretation of negligence, however, contrasts between actors' states of mind, and normative differences between kinds of goods and harms, ultimately fade into the background and become irrelevant as essential conditions for properly assessing liability. This article elaborates and defends the view that double effect analysis lies at the heart of negligence theory. Part I elucidates in more detail the principle of double effect and describes its prima facie operation in negligence analysis. Part II considers and rejects the economic efficiency interpretation that has been offered as a theory of negligence, overcoming the challenge that such an interpretation presents for the effort to locate double effect analysis in the law. Part III illustrates and confirms the overlap between double effect and negligence by consideration of a series of case applications. The Article proposes that the weighing of conflicting values in double effect analysis and negligence is not achieved - as proposed by law and economics theory with respect to negligence - by imposing a consequentialist-utilitarian reduction of all value to a single concept of good and eliminating the relevance of traditional state of mind distinctions between intention and foreseeability. Instead, each mode of analysis recognizes that distinct culpability determinations flow naturally and plausibly from an appreciation of the traditional legal distinctions made between various types of goods and harms, and upon whether such goods and harms come about as result of an actor's intention or mere foreseeability. The project of “public reason” claims to offer an epistemological resolution to the civic dilemma created by the clash of incompatible options for the rational exercise of freedom adopted by citizens in a diverse community. The present Article proposes, via consideration of a contrast between two classical accounts of dialectical reasoning, that the employment of “public reason,” in substantive due process analysis, is unworkable in theory and contrary to more reflective Supreme Court precedent. Although logical commonalities might be available to (...) pick out from the multitude of particularized accounts of what constitutes “civic order,” no “public reason” so derived could adequately capture - and thus be able to secure in a practical sense - any single determinate civic order, much less one that would be consistent with all citizens' conceptions of public order. Part I of this Article raises a number of issues for consideration relating to the epistemology of law and focuses especially on the concept of public reason and its critique. Part II addresses alternative approaches to legal reasoning suggested by classical accounts of practical reasoning and virtue theory and considers the operation of such legal analysis outside the area of substantive due process; Part III analyzes post-Lawrence case law confirming the dilemma created by the Supreme Court's ambiguous approaches to substantive due process and concludes that only one interpretation - that articulated fully in Washington v. Abstract: In Vacco v. Quill, 521 U.S. 793 (1997), the Supreme Court for the first time in American case law explicitly applied the principle of double effect to reject an equal protection claim to physician-assisted suicide. Double effect, traced historically to Thomas Aquinas, proposes that under certain circumstances it is permissible unintentionally to cause foreseen evil effects that would not be permissible to cause intentionally. The court rejected the constitutional claim on the basis of a distinction marked out by the (...) principle, i.e., between directly intending the death of a terminally ill patient as opposed to merely foreseeing that death as a consequence of medical treatment. The Court held that the distinction comports with fundamental legal principles of causation and intent. Id. at 802. -/- Critics allege that the principle itself is intrinsically flawed and that, in any event, its employment in Vacco is without legal precedent. I argue in response to contemporary objections that double effect is a valid principle of ethical reflection (Part II); claims to the contrary notwithstanding, double effect analysis is a pervasive, albeit generally unacknowledged principle employed regularly in American case law (Part III); and drawing on the preceding two sections, Vacco's application of the principle of double effect is appropriate (Part IV). -/- My conclusion is that [o]peration of some form of the principle, by whatever name, is inevitable. We studied two otherwise normal, synaesthetic subjects who `saw' a speci¢c colour every time they saw a speci¢c number or letter. We conducted four experiments in order to show that this was a genuine perceptual experience rather than merely a memory association. (i)The synaesthetically induced colours could lead to perceptual grouping, even though the inducing numerals or letters did not. (ii)Synaesthetically induced colours were not experienced if the graphemes were presented peripherally. (iii)Roman numerals were ine¡ective: the actual number grapheme was (...) required. (iv)If two graphemes were alternated the induced colours were also seen in alternation. However, colours were no longer experienced if the graphemes were alternated at more than 4 Hz. We propose that grapheme colour synaesthesia arises from `cross-wiring' between the `colour centre' (area V4 or V8)and the `number area', both of which lie in the fusiform gyrus. We also suggest a similar explanation for the representation of metaphors in the brain: hence, the higher incidence of synaesthesia among artists and poets. (shrink)

Reflections on free choice and determinism constitute a recurring, if rarified, sphere of legal reasoning. Controversy, of course, swirls around the perennially vexing question of the propriety of punishing human persons for conduct that they are unable to avoid. Drawing upon conditions similar, if not identical, to those traditionally associated with attribution of moral fault, persons subject to such necessitating causal constraints generally are not considered responsible in the requisite sense for their conduct; and, thus, they are not held culpable (...) for its consequences. The standard argument against free choice asserts that free choice cannot exist because determinism, as a property of laws governing the cosmos, excludes such a possibility. This contingent factual claim, however, has always proven problematic. Contemporary discussions - no doubt aware of this disputed factual premise - draw upon a more novel, and arguably more devastating critique: free will must be rejected because its very conception is incoherent. Rather than assuming the existence of determinism and attempting to show its incompatibility with free will, this argument begins with consideration of the idea of free choice and concludes that, if it is to have any sense at all, it must be compatible with determinism. Obviously, no single treatment of the free will problem could address all its nuances. This Article more modestly offers one possible approach to the question. Part I elaborates in more detail the view that the traditional conception of free choice is incoherent and, thus, inevitably undermines the very responsibility it is asserted to constitute; Part II considers the resulting effort to develop a model of human freedom compatible with determinism; and Part III, drawing upon the prior discussions, describes - in terms of classical action theory - a conception of free choice justifying personal moral and legal responsibility that avoids both the incoherence of "uncaused freedom" as well as the shortcomings of determinism. The 25th anniversary of R. Edward Freeman’s Strategic Management: A Stakeholder Approach provides an opportunity to consider where stakeholder theory has been, where it is going, and how it might influence the behavior of academics conducting stakeholder-oriented research. We propose that Freeman’s early work on the stakeholder concept supports the normative claim that a stakeholder’s contribution to value creation implies a right to stakeholder voice with regard to how a corporation makes decisions. Failure to account for stakeholder voice (especially (...) for non-shareholder stakeholders) works to the detriment of stakeholders. We further propose that business ethicists and stakeholder scholars have a role to play with regard to supporting the interests — including a right to voice — of non-shareholder stakeholders through advocacy, teaching, and scholarship. We use the example of industrial relations teaching and scholarship as a model for future business ethics teaching and scholarship. (shrink)

It has been my object in the present work to investigate the problems of ethics in the light of an examination of the facts of moral life. One reason for this procedure is my desire to conduct the reader by the same path that I myself have followed in approaching ethical questions.

According to comparativism, degrees of belief are reducible to a system of purely ordinal comparisons of relative confidence. (For example, being more confident that P than that Q, or being equally confident that P and that Q.) In this paper, I raise several general challenges for comparativism, relating to (i) its capacity to illuminate apparently meaningful claims regarding intervals and ratios of strengths of belief, (ii) its capacity to draw enough intuitively meaningful and theoretically relevant distinctions between doxastic states, and (...) The Caster Semenya debacle touched off by the 2009 Berlin World Athletics Championships resulted finally in IOC and IAAF abandonment of sex testing, which gave way to procedures that make female competition eligibility dependent upon the level of serum testosterone, which must be below the male range or instrumentally countered by androgen resistance. We argue that the new policy is unsustainable because (i) the testosterone-performance connection it posits is uncompelling; (ii) testosterone-induced female advantage is not ipso facto unfair advantage; (iii) (...) the new policy reflects the gender policing impulses endemic to sport as well as the broader cultural impulses to monstrify women and to doctor women who have nothing wrong with them; (iv) female?male performance disparities are not the only reason for sex-segregated sport, but co-exist with respectable cultural and practical reasons, which (v) provide a powerful case for allowing athletes to compete in the sex category congruent with their gender identity. In Salvador Dali’s Diary of a Genius, his conception of a genius, or concept perhaps, is different from a genius is an inspired specialist. From any piece of personal data about someone, one can infer whether they are a genius or not, given a full grasp of the distinction. I raise a puzzle about his conception.

As the usual regulatory framework did not fit well during the last Ebola outbreak, innovative thinking still needed. In the absence of an outbreak, randomised controlled trials of clinical efficacy in humans cannot be done, while during an outbreak such trials will continue to face significant practical, philosophical, and ethical challenges. This article argues that researchers should also test the safety and effectiveness of novel vaccines in wild apes by employing a pluralistic approach to evidence. There are three reasons to (...) test vaccines in wild populations of apes: i) protect apes; ii) reduce Ebola transmission from wild animals to humans; and iii) accelerate vaccine development and licensing for humans. Data obtained from studies of vaccines among wild apes and chimpanzees may even be considered sufficient for licensing new vaccines for humans. This strategy will serve to benefit both wild apes and humans. (shrink)

According to Marilyn Strathern, it is, or was, an axiom of social anthropology that societies differ in how they handle the same facts. I present a challenge which I anticipate and respond to it.

While researchers have examined the types of ethical issues that arise in long-term care, few studies have explored long-term care nurses’ experiences of moral distress and fewer still have examined responses to initial moral distress. Using an interpretive description approach, 15 nurses working in long-term care settings within one city in Canada were interviewed about their responses to experiences of initial moral distress, resources or supports they identified as helpful or potentially helpful in dealing with these situations, and factors that (...) hindered nurses in their responses. Using a thematic analysis process, three major themes were identified from the nurses’ experiences: (i) the context of the situation matters; (ii) the value of coming together as a team; and (iii) looking for outside direction. The work of responding to initial moral distress was more fruitful if opportunities existed to discuss conflicts with other team members and if managers supported nurses in moving their concerns forward through meetings or conversations with the team, physician, or family. Access to objective others and opportunities for education about ethics were also identified as important for dealing with value conflicts. (shrink)
